I was wondering what everyone thought about the Marvel vs City of Heroes lawsuit that has been filed. I have never played the game but it seems to me that Marvel is just being petty.
From what I gather, the basis behind Marvels suit is that they will potentialy loose business in their comic book department because fans will stop reading about their favorite heroes and instead recreate them online using CoH's awesome character customization to create a near identical copy.
To me this is like Tollkin suing EverQuest or World of Warcraft because you can create a human warrior and name him Aragorn.
Your thoughts?

Well, I have mixxed thoughts about this.
a) I like Marvel comics, always have, think Stan Lee has provided a tremendous service to humanity by making up heroes when true heroes were lacking in society.
b) I have no idea how intellectual property is copyrighted...and if they paid lawyers to do this...well they have the right to be outraged just as you did about your odd star wars/chocobo ideas...except this is how they make their living.
c) I have heard only good things about City of Heroes, and therefore would like to see it succeed after all I heard you can afk xp by being a sidekick, and who didn't grow up wanting to be a superhero groupie ala Rick Jones.
d) there must be more to this than meets the eye...knowing a little bit about the actual upper management of Marvel (I do work as a bit as a an analyst) I can say that their is probably alot more here than what is being said in the press...during the 80s and 90s Marvel was owned by two of the most egotistical corporate raiders in history (Ron Parelman owned the stock, and Carl Icahn owned the bonds) and if they never brought suit against RPGs such as Champions or Villains and Vigilantes then like I said I think their is more here (a disgruntled ex-marvel employee in breech of a noncompete or something).
Anyway I hope they lose...though we all lose when Marvel raises prices to pay the lawyers. Also Gaien it is written in the ToS for EQOA that you could not name a character even a troll...Aragorn...or Belgarath...or Elminster..or Drizzt...so...

A man whom I concider wise in cature brought up a good point to me.
Marvel may not be setting their sights on City of Heroes per say, but rather the possible infringement on copyrighted material and are simply filing suit to prevent other companies from doing the same thing to them.
I only hope CoH doesn't get nailed too bad because it looks like a blast to play. I might even go try it out myself, depending on how much $$$ it costs per month.

Agreed Gaien, it looks like a great game. I know Zug has picked up the box several times whenever we're in a video game store (around the same time I'm picking up the WoW box!). I also hear they're planning on releasing "City of Villains" -- it would be cool if they could integrate the two somehow.

They've got their own comic book too? lol! Well if they ever figure a way to intergrate the two I think I'm gonna have to buy it, and get reemed by the ball-an-chain as more of my time is spent sitting on my arse instead of with her, lol!

I read an article the other day that explains this!
It said that Mavel is developing it's own MMORPG where it would work kind of like the Matrix online, you would make your own heroes but you would sometimes tag along with the heroes of teh Marvel Universe. The article said that this was in development for the PC and next gen consoles.

ive actually seen CoH, an ive had a chance to play it, an i gotta say, i honestly hope that marvel will lose their suit becuase it is the sweetest game in the world to play, an makin the chars are so cool. the only things that keep me from playin the game full time is the fact that i gotta buy it, an its got a monthly fee. if i could pay that monthly fee i would rather come back to eqoa.

Well CoH won the suit and now Marvel is teaming up with DC to make their own MMORPG like CoH. Aparently as long as you change 10% of someone elses art or material, it becomes your own. The court also ruled that CoH cannot be held responsible for a user taking the time to recreate a copywrited characters costume.... just FYI
